Curriculum Warehouse, operated by NJ Data Diva LLC, may offer artificial intelligence (“AI”) assisted features designed to support curriculum development, instructional planning, standards alignment, resource development, and related professional educational workflows.

This AI Use Policy describes the conditions applicable to AI-assisted functionality offered through Curriculum Warehouse.

AI functionality is intended to support professional judgment, not replace it.

This Policy should be read together with the Curriculum Warehouse Terms of Service, Terms of Use, Privacy Policy, Security & Data Protection Policy, Student Data Scope, Subprocessors notice, and applicable Client agreement.

Curriculum Warehouse includes AI-assisted functionality within supported Platform features and may offer additional AI functionality over time.

AI-assisted functionality may be:

• included within a Client's subscription;
• separately enabled;
• available only to Authorized Users with access to a supported feature;
• offered as an optional enhancement or add-on;
• provided as beta, preview, pilot, or early-access functionality; or
• otherwise made available according to the applicable Client subscription or configuration.

Feature availability may vary by Client, subscription package, implementation stage, assigned permissions, or Platform configuration.

The existence of AI functionality within the Platform does not by itself establish that every AI feature is enabled or available to every Client or Authorized User.

Clients determine whether available AI-assisted functionality may be used within their organization and, where supported, which Authorized Users may access it.

Clients remain responsible for determining whether use of AI functionality is consistent with:

• Board of Education policies;
• acceptable-use requirements;
• local administrative procedures;
• collective bargaining obligations where applicable;
• professional responsibilities;
• Client AI-governance requirements; and
• applicable federal, state, and local requirements.

Available AI functionality may evolve as:

• technology changes;
• Platform capabilities develop;
• service providers change;
• Client needs evolve; or
• applicable legal and policy requirements change.

AI features identified as beta, preview, pilot, experimental, or early-access functionality may be modified, restricted, replaced, or discontinued as the Platform develops.

Curriculum Warehouse AI functionality is intended to assist educational professionals with curriculum and instructional-planning tasks.

Depending upon the functionality made available, appropriate uses may include assistance with:

• drafting curriculum content;
• generating instructional ideas;
• developing lesson-planning materials;
• organizing curriculum information;
• suggesting instructional resources or activities;
• supporting standards alignment;
• drafting essential questions or learning objectives;
• generating possible assessments or learning tasks;
• adapting or refining instructional materials;
• summarizing curriculum information;
• revising or reorganizing professional curriculum content; and
• other curriculum or instructional-planning activities supported by the Platform.

AI-assisted content should be treated as a starting point or draft, not as automatically approved curriculum or official Client content.

AI-generated or AI-assisted content requires appropriate human review before it is:

• adopted into official curriculum;
• published;
• shared publicly;
• incorporated into lesson plans;
• presented as district-approved material;
• relied upon for instructional decision-making; or
• otherwise used for official educational purposes.

Authorized Users remain responsible for evaluating AI-assisted output for:

• accuracy;
• completeness;
• factual reliability;
• instructional appropriateness;
• standards alignment;
• age and grade-level suitability;
• accessibility;
• bias;
• copyright or attribution concerns;
• possible third-party rights;
• district policy compliance; and
• professional quality.

Use of an AI-assisted feature does not transfer professional responsibility for the resulting content to NJ Data Diva LLC.

The availability of an AI-assisted feature does not constitute NJ Data Diva LLC approval of a particular Client's use of AI.

Clients remain responsible for establishing and enforcing their own:

• AI governance requirements;
• Board policies;
• acceptable-use rules;
• professional expectations;
• review procedures; and
• publication or approval processes.

• Prompts and generated content processed through Curriculum Warehouse AI features are handled in accordance with national educational AI privacy standards, including the NAfAI School AI Privacy Standards. Covered Data submitted to AI tools shall not be harvested, retained, or utilized for external model training or synthetic data generation. System logs for AI interactions are maintained strictly for operational troubleshooting, session delivery, and required safety or security oversight.

Artificial intelligence systems may produce output that is:

• inaccurate;
• incomplete;
• outdated;
• misleading;
• biased;
• inconsistent;
• inappropriate for a particular learner or instructional context;
• incorrectly attributed;
• unsupported by reliable sources;
• duplicative of existing material;
• potentially subject to third-party rights; or
• otherwise unsuitable for official use.

AI systems may generate information that appears authoritative even when it is incorrect.

Curriculum Warehouse does not warrant the:

• factual accuracy;
• completeness;
• originality;
• uniqueness;
• copyright eligibility;
• noninfringement; or
• instructional suitability

of AI-generated output.

Users should independently review and verify important information before relying upon AI-assisted content.

Student Identifiable Information (“SII”) must not be submitted to Curriculum Warehouse AI-assisted functionality.

This prohibition applies regardless of whether a Client has enabled or authorized use of an AI feature.

Users must not submit information such as:

• student names or other identifying information;
• student identification numbers;
• grades tied to an identifiable student;
• Individualized Education Programs (IEPs);
• special education information tied to an identifiable student;
• student health or medical information;
• disciplinary or counseling information;
• personally identifiable assessment information;
• student rosters;
• identifiable student work; or
• other confidential student information or education records.

Where instructional context is useful, users should use generalized or de-identified descriptions that do not identify an individual student.

Curriculum Warehouse AI functionality is intended for professional curriculum and instructional-planning support, not the processing or storage of Student Identifiable Information.

Additional requirements regarding student information are provided in the Curriculum Warehouse Student Data Scope.

Users should exercise reasonable care before submitting personal, confidential, restricted, proprietary, or sensitive information to an AI-assisted feature.

Such information should only be submitted when:

• the feature is intended to process that type of information;
• the information is reasonably necessary for the requested function;
• the Client authorizes the use; and
• the submission is permitted by applicable Curriculum Warehouse policies, Client policies, contractual obligations, and law.

This section does not create an exception permitting Student Identifiable Information to be submitted to AI-assisted functionality.

Users must not submit:

• passwords;
• authentication credentials;
• access tokens;
• private encryption keys;
• security secrets;
• private API credentials; or
• other information that could permit unauthorized access to a system or account.

Users should provide only the minimum information reasonably necessary to obtain the desired AI-assisted result.

Where identifiable, confidential, proprietary, or sensitive information is not necessary, users should:

• omit it;
• generalize it;
• redact it; or
• de-identify it

before submitting the request.

Curriculum Warehouse encourages users to avoid including names, personal identifiers, confidential business information, or other unnecessary identifying information in AI prompts.

Curriculum Warehouse uses Google Gemini, provided by Google LLC, to support certain production AI-assisted functionality within the Platform.

Authorized Users with access to supported AI functionality may initiate requests to Google Gemini through Curriculum Warehouse features, including supported lesson-planning functionality.

When an Authorized User invokes an applicable AI-assisted feature, information submitted through that feature may be transmitted to and processed by Google Gemini as reasonably necessary to generate the requested output.

Curriculum Warehouse currently uses the Gemini 2.5 Flash model for supported AI-assisted lesson-content generation. The particular model or model version used may change over time as Curriculum Warehouse functionality, Google services, technical requirements, cost, performance, or responsible-use considerations evolve.

Google LLC is therefore identified as an AI subprocessor on the Curriculum Warehouse Subprocessors page.

Student Identifiable Information must not be submitted to Curriculum Warehouse AI-assisted functionality.

NJ Data Diva LLC does not use Client-specific curriculum data to train external AI models.

Curriculum Warehouse will update its Subprocessors disclosure as applicable when production AI providers are added, removed, or materially changed.

NJ Data Diva LLC does not use Client-specific curriculum data to train external AI models.

Where third-party AI services are used, Curriculum Warehouse will select and configure those services consistent with this commitment where technically applicable.

This commitment applies to NJ Data Diva LLC's use of Client-specific curriculum information and does not represent that Curriculum Warehouse controls the independent development or general training practices of an AI provider beyond the applicable service terms, configuration, or contractual relationship.

Curriculum Warehouse may use aggregated or de-identified information regarding AI-feature utilization to:

• understand general feature usage;
• evaluate performance;
• identify technical or usability concerns;
• improve Platform workflows;
• evaluate future functionality; and
• inform product development.

Such information will be handled in accordance with the Curriculum Warehouse Privacy Policy.

Curriculum Warehouse will not intentionally re-identify properly de-identified information used for these purposes.

Information processed through AI functionality remains subject to the Curriculum Warehouse Privacy Policy, Security & Data Protection Policy, applicable Client agreements, and relevant data-protection requirements.

AI functionality does not change the prohibition against submitting Student Identifiable Information to Curriculum Warehouse.

Authorized Users may not use Curriculum Warehouse AI functionality to:

• violate applicable law;
• circumvent Platform security or access controls;
• generate malicious code for unauthorized or harmful purposes;
• facilitate unauthorized system access;
• harass, threaten, bully, intimidate, or unlawfully discriminate against another person;
• intentionally generate obscene, exploitative, or unlawful material;
• impersonate another person in a deceptive or harmful manner;
• intentionally create false records;
• falsify official curriculum approvals;
• knowingly infringe third-party intellectual-property rights;
• disclose confidential information without authorization;
• submit or process prohibited Student Identifiable Information;
• make deceptive representations that unreviewed AI output has been formally approved by a Client;
• interfere with the operation or security of Curriculum Warehouse;
• use automated methods to abuse or circumvent AI usage restrictions; or
• use AI functionality in a manner prohibited by the applicable Client's policies.

Curriculum Warehouse AI functionality is not designed to process Student Identifiable Information or make individualized student decisions.

AI-generated output must not be used as the sole basis for decisions concerning an identifiable student's:

• educational placement;
• eligibility for disability services;
• Individualized Education Program;
• accommodations or modifications;
• disciplinary status;
• grades;
• assessment outcomes; or
• other individualized educational rights.

Because Student Identifiable Information must not be submitted to Curriculum Warehouse AI functionality, users should not use the feature to conduct individualized analysis of a particular student.

AI-generated output should likewise not be used as the sole basis for:

• employment decisions;
• disciplinary decisions;
• performance evaluations; or
• other material employment-related decisions concerning Client personnel.

Nothing in Curriculum Warehouse AI functionality is intended to replace legally required professional review, individualized decision-making, due process, or established Client procedures.

Client curriculum content submitted to an AI-assisted feature remains subject to the ownership provisions of the applicable Client agreement and Curriculum Warehouse Terms of Service.

NJ Data Diva LLC does not claim ownership of Client curriculum content merely because it is submitted through an AI-assisted feature.

As between NJ Data Diva LLC and the Client, NJ Data Diva LLC does not claim ownership of AI-assisted output solely because it was generated using Curriculum Warehouse.

However, generation of AI-assisted output does not guarantee that the output is:

• eligible for copyright protection;
• unique;
• original;
• non-infringing;
• accurate; or
• free from third-party rights.

Users and Clients remain responsible for reviewing AI-generated material before publication, distribution, incorporation into official curriculum, or other official adoption.

Clients are responsible for determining whether their:

• policies;
• professional standards;
• grant requirements;
• publication practices;
• academic-integrity requirements; or
• applicable law

require disclosure or attribution when AI has materially assisted in creating content.

Where Curriculum Warehouse visibly identifies content as AI-assisted, users should not intentionally remove or manipulate that identification for the purpose of misleading others regarding how the content was created.

AI-assisted functionality may be:

• included within a Client subscription;
• separately enabled;
• subject to separate subscription fees;
• subject to usage-based fees;
• subject to feature-specific limits; or
• subject to other pricing or availability conditions disclosed in advance.

Applicable fees or included AI functionality will be identified through the Client's:

• Order Form;
• proposal;
• written agreement;
• subscription configuration; or
• applicable Platform-based usage controls.

The existence of AI functionality within the Platform does not by itself establish whether that functionality is included within a particular Client's subscription.

Curriculum Warehouse may establish reasonable usage limits where necessary to:

• manage third-party AI costs;
• protect Platform performance;
• prevent abuse;
• maintain equitable access;
• address technical limitations; or
• comply with third-party provider restrictions.

Material paid usage limitations will be disclosed to Clients as appropriate.

NJ Data Diva LLC may restrict or disable AI-assisted functionality when reasonably necessary because of:

• misuse;
• suspected security abuse;
• repeated violation of this Policy;
• unlawful activity;
• submission of prohibited information;
• excessive or abusive automated activity;
• circumvention of usage restrictions; or
• a third-party provider restriction that affects continued availability.

Where practical, Curriculum Warehouse will work with the applicable Client administrator regarding user-specific concerns.

AI technology and provider relationships may change over time.

Curriculum Warehouse may:

• add or replace AI providers;
• modify AI-supported functionality;
• change model configurations;
• introduce or remove AI features; or
• modify usage limits

as Platform needs, technology, cost, security, responsible-use considerations, or applicable requirements evolve.

Where a production third-party AI provider will process Client Content or Authorized User personal information, applicable Subprocessor disclosures will be updated as appropriate.

NJ Data Diva LLC may update this AI Use Policy as AI technology, Platform functionality, applicable requirements, third-party providers, responsible-use practices, or business operations evolve.

The current version will be published within the Curriculum Warehouse Terms & Policies center with an updated “Last Updated” date.
