Curriculum Warehouse Terms of Use

These Terms of Use (“Terms of Use”) apply to individuals who access or use the Curriculum Warehouse Platform provided by NJ Data Diva LLC (“Curriculum Warehouse,” “Provider,” “we,” “us,” or “our”).

By accessing Curriculum Warehouse through an account authorized by a school district, school, educational institution, or other Client, an Authorized User agrees to use the Platform in accordance with these Terms of Use, the applicable Client agreement, and the other policies published within the Curriculum Warehouse Terms & Policies center.

These Terms of Use supplement the Curriculum Warehouse Terms of Service. If an Authorized User's organization has entered into a separate written agreement with NJ Data Diva LLC, that agreement may contain additional requirements governing use of the Platform.

1. Authorized Use

1.1 Authorized Users

Curriculum Warehouse is designed primarily for authorized educational professionals and administrators.

Users may access the private Curriculum Warehouse Platform only when authorized by a Client and only for legitimate educational, curriculum, instructional, administrative, professional-development, or related organizational purposes.

Students are not intended to be Authorized Users of the private Platform.

1.2 Client-Controlled Access

The Client determines:

  • who may access its private Curriculum Warehouse environment;
  • which Platform role each Authorized User receives;
  • which departments, courses, curriculum areas, or administrative functions a user may access; and
  • when an individual's access should be modified, deactivated, or removed.

Current Client-level Platform access roles may include:

  • Admin;
  • Supervisor;
  • Editor; and
  • Viewer.

An account may also be placed in an Inactive state that prevents ordinary Platform access.

A separate Corporate Admin role is reserved for authorized NJ Data Diva LLC personnel with legitimate Provider-level administrative responsibilities.

1.3 Use Within Assigned Permissions

Authorized Users must use the Platform only within the permissions associated with their assigned account and role.

Users may not attempt to bypass, expand, alter, or circumvent their assigned permissions without authorization.

Access to one Client's Curriculum Warehouse environment does not authorize access to another Client's private environment.

2. Account and Credential Security

2.1 Accurate Account Information

Authorized Users should provide accurate professional account information and promptly notify their Client administrator if relevant account information is incorrect or requires updating.

2.2 Individual Accounts

Individual user accounts are intended for use by the person to whom the account is assigned.

Users may not:

  • share credentials with unauthorized individuals;
  • permit another person to use their account to circumvent access restrictions;
  • use another person's credentials;
  • impersonate another user; or
  • knowingly allow unauthorized access through their account.

2.3 Protecting Credentials

Users are responsible for taking reasonable steps to protect their:

  • accounts;
  • devices;
  • authentication credentials; and
  • access to supported identity-provider accounts.

Users should promptly report suspected compromised credentials, unauthorized access, or other account-security concerns to their Client administrator or Curriculum Warehouse.

2.4 Single Sign-On

Where access is provided through Google Workspace, Microsoft 365, or another supported identity provider, users remain responsible for complying with the security requirements applicable to that account.

Curriculum Warehouse does not receive or store a user's Google Workspace or Microsoft 365 password.

For accounts using Firebase Authentication rather than SSO, authentication credentials are managed through the applicable authentication service. NJ Data Diva LLC personnel do not have access to users' plain-text passwords.

3. Prohibited Technical Activity

Authorized Users may not attempt to compromise, interfere with, reproduce, or obtain unauthorized access to Curriculum Warehouse.

Prohibited activities include:

  • accessing or attempting to access another Client's private Platform environment without authorization;
  • bypassing authentication, role-based permissions, or other security controls;
  • probing, scanning, or testing Platform vulnerabilities without prior written authorization from NJ Data Diva LLC;
  • introducing viruses, malicious code, ransomware, destructive software, or other harmful material;
  • interfering with Platform availability, performance, or normal operation;
  • intentionally overwhelming Platform resources;
  • modifying, adapting, hacking, or tampering with the Platform;
  • reverse engineering, decompiling, disassembling, or attempting to derive Platform source code or proprietary logic except where such restriction is prohibited by law;
  • attempting to replicate proprietary converter logic, workflows, architecture, or other protected Platform functionality;
  • scraping or systematically extracting Platform information through unauthorized automated methods;
  • using bots, scripts, screen scrapers, crawlers, or other automated access mechanisms except where expressly supported or authorized by Curriculum Warehouse;
  • using the Platform to test, develop, or assist in developing a competing product through unauthorized access to proprietary functionality; or
  • attempting to interfere with Client separation or obtain data belonging to another Client.

Nothing in this section prohibits normal use of Platform-provided import, export, reporting, integration, or automation functionality.

4. Content and Information Submitted to the Platform

4.1 Appropriate Content

Authorized Users may create, upload, edit, publish, or manage content only where permitted by their Client and assigned Platform role.

Users are responsible for using reasonable care when submitting content to Curriculum Warehouse.

4.2 Rights to Content

Users should not knowingly upload, publish, or distribute material that:

  • infringes another person's copyright, trademark, or other intellectual-property rights;
  • violates confidentiality obligations;
  • unlawfully discloses personal information;
  • violates another person's privacy rights; or
  • the user is not authorized to use or distribute.

4.3 Unlawful or Harmful Content

Users may not use Curriculum Warehouse to knowingly create, upload, transmit, or distribute content that is:

  • unlawful;
  • fraudulent;
  • malicious;
  • threatening;
  • harassing;
  • discriminatory in violation of applicable law;
  • obscene or pornographic;
  • intentionally deceptive in connection with Platform administration;
  • designed to facilitate unauthorized access or cybersecurity abuse; or
  • otherwise prohibited by applicable law or Client policy.

4.4 Client Curriculum Content

Curriculum content created or uploaded within a Client's environment is governed by the Client's policies and applicable agreement with Curriculum Warehouse.

Authorized Users do not acquire ownership rights in Curriculum Warehouse technology merely by using the Platform.

Content created within one Client environment does not automatically transfer to another Client environment if an Authorized User changes employers.

5. Student Information

5.1 No Student Identifiable Information

Curriculum Warehouse is designed for authorized educational professionals and administrators.

It is not designed to collect, solicit, maintain, or store Student Identifiable Information (“SII”) or student education records.

Authorized Users must not upload, create, maintain, or store Student Identifiable Information within Curriculum Warehouse.

This includes, but is not limited to:

  • student grades;
  • Individualized Education Programs (IEPs);
  • student identification numbers;
  • student health or medical information;
  • identifiable student assessment records;
  • disciplinary or counseling records;
  • student rosters;
  • identifiable student work; or
  • other confidential student information or education records.

Student information must not be placed within curriculum maps, units, lesson plans, instructional resources, attachments, administrative fields, public curriculum displays, or other Platform content areas.

5.2 Students Are Not Authorized Users

Students are not intended to be Authorized Users of the private Curriculum Warehouse Platform.

Authorized Users may not knowingly provide students with access to:

  • private district curriculum environments;
  • curriculum editing or authoring tools;
  • administrative functionality;
  • private instructional resources; or
  • other restricted Platform functionality.

5.3 Unintended Student Authentication

Curriculum Warehouse may support Single Sign-On (“SSO”) through Client-managed identity providers such as Google Workspace or Microsoft 365.

In limited circumstances, a student account may attempt to authenticate because of:

  • Client identity-provider configuration;
  • shared staff and student email domains;
  • access-approval settings; or
  • another Client-controlled configuration.

If this occurs, Curriculum Warehouse may receive limited authentication or security information supplied by the identity provider, such as:

  • name;
  • email address;
  • account identifier;
  • authentication provider;
  • date and time of the authentication attempt; and
  • related technical or security information.

An unintended student authentication attempt does not authorize the student to use Curriculum Warehouse and does not convert the Platform into a student-facing service.

5.4 Reporting Student Information or Access

If an Authorized User becomes aware that:

  • Student Identifiable Information has been uploaded to the Platform;
  • a student has unintentionally authenticated to or accessed the Platform; or
  • another student-access concern has occurred,

the user should notify the Client administrator or Curriculum Warehouse promptly.

Curriculum Warehouse may take reasonable steps to:

  • restrict unauthorized access;
  • remove prohibited information;
  • review relevant authentication or audit records;
  • deactivate an unauthorized account; and
  • assist the Client with appropriate remediation.

Additional requirements are provided in the Curriculum Warehouse Student Data Scope.

6. Administrative Actions and Platform Activity

6.1 Activity Records

Use of Curriculum Warehouse generates system and audit records associated with certain Platform activity.

Depending upon Platform functionality, these records may include:

  • authentication and login activity;
  • session dates and times;
  • active session duration;
  • administrative actions;
  • curriculum changes;
  • publishing or approval activity;
  • exports or downloads; and
  • other Platform interactions.

6.2 Active Session Duration

Curriculum Warehouse may track the duration of active Platform sessions for purposes such as:

  • session management;
  • operational visibility;
  • usage analysis;
  • Platform administration;
  • troubleshooting;
  • security; and
  • Platform improvement.

Active session duration reflects activity within Curriculum Warehouse and is not intended to establish an individual's actual working hours or time spent performing duties outside the Platform.

6.3 Client Administrative Access

Certain Platform activity information may be available to authorized Client administrators based upon their roles and permissions.

Users should understand that actions performed within a Client-managed Curriculum Warehouse environment may therefore be visible to authorized administrators of that Client.

Depending upon Platform configuration and permissions, this may include information relating to Platform sessions and active session duration.

6.4 Scope of Monitoring

Curriculum Warehouse does not monitor a user's browsing, communications, device activity, or online activity outside of the Curriculum Warehouse Platform.

Platform activity information, including active session duration, is not designed as a payroll, attendance, or employee timekeeping system and should not be relied upon as the sole measure of:

  • attendance;
  • hours worked;
  • productivity;
  • compensation eligibility; or
  • job performance.

The Client remains responsible for its own use of administrative activity information in accordance with applicable law, Board policy, employment agreements, collective bargaining obligations, and internal procedures.

Collection and use of Platform activity information are described more fully in the Curriculum Warehouse Privacy Policy.

7. Artificial Intelligence Features

Where a Client enables AI-assisted Curriculum Warehouse functionality, Authorized Users must use those features in accordance with:

  • the Curriculum Warehouse AI Use Policy;
  • applicable Client or Board of Education policies;
  • the Client's acceptable-use requirements;
  • applicable law; and
  • professional responsibilities applicable to the user's role.

AI-generated material should be treated as draft content requiring appropriate human review before:

  • adoption;
  • publication;
  • incorporation into official curriculum;
  • instructional use; or
  • other official reliance.

Users remain responsible for evaluating the:

  • accuracy;
  • appropriateness;
  • standards alignment;
  • instructional quality;
  • potential bias;
  • copyright considerations; and
  • overall suitability

of AI-assisted output.

Student Identifiable Information must not be submitted to Curriculum Warehouse AI-assisted functionality.

Users should not submit confidential, restricted, or sensitive information to an AI feature unless the use is permitted by Curriculum Warehouse policies, the Client, and applicable law.

Where a third-party AI provider processes Client information through production AI functionality, the applicable provider will be identified through the Curriculum Warehouse Subprocessors page.

8. Public Publishing and Sharing

Certain users may be authorized to publish curriculum information through public-facing Curriculum Warehouse functionality.

Users with publishing privileges must use reasonable care before making information public.

Before publication, users should confirm that content:

  • is intended for public access;
  • is appropriate for publication;
  • does not contain confidential or restricted information;
  • does not unintentionally contain personal information;
  • does not contain Student Identifiable Information;
  • does not contain student education records; and
  • is authorized for publication under Client procedures.

Curriculum Warehouse provides the technical publishing functionality.

The Client remains responsible for determining what information its personnel are authorized or required to publish.

9. Violations, Suspension, and Account Removal

NJ Data Diva LLC or the applicable Client may restrict, suspend, deactivate, or terminate an individual's Platform access when reasonably necessary because of:

  • loss of Client authorization;
  • assignment to an Inactive account state;
  • suspected unauthorized access;
  • compromised credentials;
  • violation of these Terms of Use;
  • malicious or unlawful activity;
  • attempted circumvention of security controls;
  • unauthorized vulnerability scanning or security testing;
  • unauthorized automated scraping or extraction;
  • activity that threatens another Client or the Platform;
  • misuse of proprietary Curriculum Warehouse technology; or
  • another legitimate security or administrative reason.

Where reasonably practical, Curriculum Warehouse will work with the applicable Client administrator to address user-related concerns.

NJ Data Diva LLC may take immediate protective action when reasonably necessary to prevent:

  • unauthorized access;
  • security harm;
  • data loss;
  • malicious activity; or
  • material interference with the Platform.

Termination or deactivation of an individual's account does not determine ownership of curriculum content created within the Client's environment.

Such content remains governed by the Client agreement and applicable Client policies.

10. Related Policies, Changes, and Contact

10.1 Related Policies

Use of Curriculum Warehouse is also governed, as applicable, by:

  • Curriculum Warehouse Terms of Service;
  • Curriculum Warehouse Privacy Policy;
  • Curriculum Warehouse Security & Data Protection Policy;
  • Curriculum Warehouse AI Use Policy;
  • Curriculum Warehouse Student Data Scope;
  • Curriculum Warehouse Service Level Agreement;
  • Curriculum Warehouse Subprocessors notice; and
  • other policies incorporated into the applicable Client agreement.

10.2 Changes to These Terms of Use

NJ Data Diva LLC may update these Terms of Use from time to time to reflect changes in:

  • Platform functionality;
  • security practices;
  • technology;
  • authentication;
  • user roles;
  • business operations;
  • service providers; or
  • applicable requirements.

The current version will be published within the Curriculum Warehouse Terms & Policies center with an updated “Last Updated” date.
